TERMS OF PARTICIPATION IN THE PROGRAM

Please READ carefully. By purchasing and enrolling in this service, the following Terms and Conditions (“Terms”) are established between Erika Mortier (“Company,” “we,” or “us”) and you (“Client” or “You”), and you accept the following terms set forth herein. The Company and you may be referred to individually as a “Party” and collectively as the “Parties” in these Terms.

PROGRAM

The Company undertakes to provide the program titled “Building Empires,” as described on the website where you register, which includes:

– Creation of a 10-page website, including blog, store, sales pages, or whatever suits the client’s needs.
– A 1-hour brand strategy call if deemed necessary.
– A 30-minute website strategy call.
– A provided brand color palette, consisting of 4-6 colors, 2-3 fonts, and a Logo with name.
– Customized desktop and mobile versions of your website, including full mobile and desktop optimization of all its content.
– Hosting, domain, and SSL for one year.
– Monthly plugin updates and WordPress versions for one year.
– A monthly backup, which will be sent to the Client for storage.
– Up to one monthly content modification requested by the Client. This may be the modification of ONE element (e.g., a photo, text, title, etc.).

The Company undertakes to provide the program titled “Founding Foundations,” as described on the website where you register, which includes:

– Creation of a landing page with up to 4 sections.
– A 1-hour brand strategy call if deemed necessary.
– A 30-minute website strategy call.
– A provided brand color palette, consisting of 4-6 colors, 2-3 fonts, and a Logo with name.
– Customized desktop and mobile versions of your website, including full mobile and desktop optimization of all its content.
– Hosting, domain, and SSL for one year.
– Monthly plugin updates and WordPress versions for one year.
– A monthly backup, which will be sent to the Client for storage.
– Up to one monthly content modification requested by the Client. This may be the modification of ONE element (e.g., a photo, text, title, etc.).

The Company undertakes to provide the program titled “Creating Brands,” as described on the website where you register, which includes:

– Creation of a 5-page website.
– A 1-hour brand strategy call if deemed necessary.
– A 30-minute website strategy call.
– A provided brand color palette, consisting of 4-6 colors, 2-3 fonts, and a Logo with name.
– Customized desktop and mobile versions of your website, including full mobile and desktop optimization of all its content.
– Hosting, domain, and SSL for one year.
– Monthly plugin updates and WordPress versions for one year.
– A monthly backup, which will be sent to the Client for storage.
– Up to one monthly content modification requested by the Client. This may be the modification of ONE element (e.g., a photo, text, title, etc.).

PAYMENTS

Payment for access to the program will be made in two stages, with 50% of the total service fee paid in each. The first payment shall be made upon acceptance of this contract, and the remaining 50% after 30 days.

The client understands and accepts that they are financially responsible for all payments. If payment is not made on time according to the payment plan after we have attempted to collect it, access to the program and all progress made up to that point will be forfeited.

We do not tolerate or accept any kind of chargeback from the Client’s credit card. If the client needs to terminate this agreement before the Program, the client forfeits all money already paid to secure the day in the Company’s schedule. Therefore, there are no refunds whatsoever.

REFUNDS

Due to the nature of the Program and the services provided by the Company, there are no refunds for any service provided by the Company under this Program.

STATUS OF INDEPENDENT CONTRACTOR:

It is expressly agreed and understood that the Company is performing services under this Agreement as an Independent Contractor of the Client and that the Company is not an employee or agent of the Client. The company shall have exclusive control over the detailed method of performing the services, as well as the facilities and resources necessary to perform the services.

WORK PRODUCT AND PROPRIETARY INFORMATION:

It is understood and agreed that all deliverables produced by the Company under this Agreement become the property of the Client once the “Client” has paid all compensation due under this Agreement in full. In the event that any deliverable is a work that embodies intellectual property rights, including, among others, copyright and other proprietary rights, the Company hereby assigns to the Client all rights, titles, and interests therein.

The Company retains the ability to use the deliverables produced under this Agreement for marketing, promotional, social media, and/or educational purposes, provided that (i) the data is anonymized, except for the Client’s name, domain URL, and information that is not the Client’s intellectual property or private, and (ii) the Company protects the Client’s private data at all times. The Client agrees that the Service Provider may use the site, both during and after its development, in any marketing materials they choose.

Furthermore, it is understood and agreed that any specific client information developed, obtained, or provided to the Company under this Agreement shall remain the property of the Client and shall be subject to the exclusive control of the Client once the mentioned project and agreement have commenced.

The Client authorizes, releases, and consents to the Company for any use of the Client’s name, likeness, image, voice, and written words for promotional or advertising purposes.

Any design created by the Company may not be resold or redistributed in any way to third parties unless it is as an affiliate marketing partner of the Company. In the event that another designer works on this website created by the Company in the contracted experience, the website must remain labeled “Designed by Evoltek Web Design” in the site footer with the text linked to evoltek.com.ar for a period of five years after these terms have been agreed upon with the Client.

NOTIFICATIONS:

Any notice required or desired under this Agreement shall be deemed delivered when made in writing and shared via email with the Client at the Client’s email address on file or entered during registration for the Program, and with the Company at the Company’s email address: hola@evoltek.com.ar.

CLIENT DELIVERABLES BEFORE THE PROGRAM:

This section constitutes a strict delivery agreement to ensure that the Company can perform the tasks outlined in section one. The following materials must be provided before the Brand Call on the intensive day:

– The client must have filled out the form provided requesting their personal and contact information.
– The client must have decided on the Branding proposals made.
– The client must have informed their decision regarding the domain name.
– Gather testimonials from previous clients to use on the website.
– Create gifts or lead magnets for potential clients to use on the website.
– Website text for each of the pages.
– External links to be used on the website.
– Client photos must be sent to the Company before design.

RESCHEDULING AND CANCELLATION POLICY:

We understand that things happen. We allow rescheduling by the client if done with more than 24 hours’ notice before the start of our intensive session. If there is an

emergency within 24 hours, please contact us to see how we can make things work in the future.

I expect my clients to be available during the intensive design days. You may make calls and carry out your activities while I design, but if questions arise, I need responses within a maximum of two hours. If I am designing and have not received a response in more than two hours, I will proceed with the designs, and you will lose the option to make edits in that section. I don’t want this to happen, so please be attentive! Inform me if you have commitments or appointments while we’re on our first call of the day so I know when you may be busy.

THE PARTIES HAVE READ AND UNDERSTOOD THE ABOVE TERMS AND AGREE TO THEM.
